中介房东乱扣bond金怎么办呢???

       阳光清洁在多年为广大华人朋友服务期间发现,大家对nsw的租房法规知之甚少。导致在退房的时候经常会遇到黑心的房东或则中介的百般刁难,甚至是把几千块的押金全部扣掉的也不少见。当然多数的房东或则中介要求扣除押金是有原因的,主要是因为清洁或则房屋损坏的原因,但是要是遇到黑心的房东或则中介该怎么办呢?本着为广大华人朋友服务的宗旨,阳光清洁将不定期的推出各种租房方面的知识。

     本篇我们将首先介绍大家极为关心的退房时候如何顺利的退回押金。

当我们和房东或则中介租房的时候会签署一份租房合同,这份合同会和押金一起寄到fair trading的"按金局"。当局会在十四天内书面通知租户按金已在他的保管之内,除非租约中断或者期满不续约,按金一直会存放在按金局内,到租约终止。谁可以拿到按金?基本上有三种可能:
    第1, 业主同意租户完满履行租约的责任。换句话说,租金交足,楼已清洁,没有破损。这样业主和租户双方应填妥并签署一份按金提取表格(Bond Claim Form),然后寄往按金局等待退款。
 
    第2, 租户同意业主从按金中扣除一部分以作赔偿租金或修理费。和以上的情况一样,也祝贺租户。双方应填好一份按金提取表格寄往按金局。注意租户和业主的协定不能再租约结束前超过七天达成,因为按金局不会接受这么早便达成的协定。
 
    第3, 如果租户和业主就谁应得到按金或者其比例有不同意见的话,租户可以自行向fair trading递交退回押金的表格。fair trading收到租户递交的表格后,会发信给业主或则中介。给他们14天的时间和你协商解决这个问题。如果他们在14天内没有回复。押金将会自动打到租户的账户上。如果业主或中介对退回全额的押金有异议的话。他们会向租务法庭递交裁决申请。租户也可以自行向法庭申请。法庭接到申请后,会安排审讯日期时间,通知业主和租户出席。法庭聆听双方的理由后,会作适当的判决,之后还会把按金提取表格同法庭判决寄往按金局。需要指出的是业主或则中介也是可以单独递交退回押金的表格的。所以租户的回复时间也是14天。
 
      最后还有一种可能:租户不动声色自行搬走。一般租户不会留下通讯位址,亦可能欠下租金。这样业主可向租务法庭申请要求用按金作抵押。法庭又可能会不开庭便判给业主。租户在特殊情况下,可能得到法庭重新聆听的机会。

    通常呢,我们华人朋友会遇到的是第2中可能。我们公司的员工在于西人中介公司打交道了这么多年,提醒大家要注意的是那些小型的中介公司,这些公司呢蛮多是制度不健全,甚至是家族企业的都有。在退房检查时,根本不按规矩来,看哪不顺眼就说哪不行,百般刁难。如果遇到这种的中介公司,不要与之争吵,先要看看他们所说的是否属实。对于事实存在的问题,应该配合他们把问题解决。例如是在清洁方面的问题,一般中介都会给予1次返工的机会。如果已经确认他们所指出的问题已经解决了,可以他们还要扣除一定的押金的时候。我们华人朋友一定要拿起法律的武器捍卫自己。这样的话,就是第3中可能了。
